It took them two years to get here; two years and a long road of surgeries, rehab, and litigation - but finally, the case is won.
Today, a proposed judgment is being filed in Maricopa County Superior Court on a $1.2 million dollar verdict that Phoenix attorneys Mark and Alexis Breyer have been working on since 2010. The Husband & Wife Law Team, as they are also known, took on this serious motorcycle collision case in July 2010. According to court documents for the case, number CV2010-080664, their client was on a motorcycle, waiting to take a left on a green light. He was hit by someone who ran a red light on July 12, 2010 at Palm Lane and 3rd St in Phoenix. Witnesses say the motorcyclist was thrown high into the air off of his bike.
His injuries, as stated in court documents, included a shattered pelvis, requiring immediate surgery. He was rushed to the hospital by ambulance, and was in ICU for days before spending almost two weeks in the hospital. The previously active rider suffered more than physical injuries. His entire lifestyle has been altered because of this collision.
Additional information within the court documents for case CV2010-080664 further states that the Breyers’ client had to stay in a rehab hospital. He wasn’t out of the woods yet. He caught a staph infection and needed several skin graft surgeries to cover his extensive road rash injuries.
Despite all his setbacks in his treatment, the client somehow always fought to maintain good spirits. Perhaps it was because all the while, Mark and Alexis were working hard on his case. Initially, the client offered to settle with the insurance company for $15,000, but that offer was not accepted by the insurance company, who wanted to insist on unreasonable terms. The Husband & Wife Law Team refused to agree to these terms and took the case all the way to trial.
Mark Breyer delivered the arguments at trial for his client. Judge David Cunanan of the Maricopa County Superior Court presided over the case. The client was awarded $1,200,000. That’s about $1,185,000 more than the original offer.
Helping Prevent Accidents
While Mark Breyer works very hard fighting for riders who have been injured in accidents, he finds it just as important to work to prevent these kinds of accidents from even happening.
He recently joined the board of the Arizona Motorcycle Safety and Awareness Foundation, to work with others who are passionate about rider safety and safety for all on the roads.
Last year, 132 Arizonans were killed in motorcycle accidents, according to the Arizona Department of Transportation. Unfortunately, this number is 35% higher than 2010’s statistics; and motorcycle registrations continue to climb, which leads to even more bikers on the road, and an even more pressing need to promote motorcycle awareness.
