Causes of Distracted Driving Accidents
Distracted driving accidents happen every day and are becoming more prevalent with the increase in the number of drivers on the road with "something else" to focus on other than the task of driving. According to the Arizona Department of Transportation (ADOT), around 1,660 traffic collisions are primarily caused by distracted drivers each year throughout the state. And these accidents don’t just happen because of beautiful scenery. Some of the most common causes of distracted driving collisions on the roads of Arizona, include, but are not limited to, the following.
Talking, or texting, on a cell phone while driving, often removing their hands from the wheel, or taking their eyes off of the road.
Fumbling with the radio while driving.
Carrying on conversations while driving, and engaging in those conversations by turning the head or looking into the rearview mirror.
Conducting personal hygiene activities while driving, including brushing teeth, brushing hair, or shaving.
Taking care of children.
Pressing buttons on the radio or portable music device.
Using a GPS.
Eating or drinking while driving.
Getting distracted by frustrations built up from dealing with difficult traffic or drivers.
Having a pet in the car.
These aren't all the types of distractions for today's drivers. What is important to know is they've all been measured as being just as dangerous as driving drunk.
Who Is Responsible for My Distracted Driving Crash?
As with other types of car wrecks, figuring out who is responsible for your distracted driving accident is only part of the battle. You are probably also wondering whether or not that individual will be held responsible for their actions that led to your injuries, and whether the insurance company will stand by your side to help make that happen. Working with a skilled personal injury lawyer is the best way to ensure that it does. Our attorneys investigate every aspect of your case, from the crash to the reports, to interviewing witnesses, and to reviewing your injuries and progress towards recovery, all in an effort to build a strong case that not only shows who is liable for your accident and your injuries, but for exactly what they are liable.
How Much Compensation Will I Get for My Settlement?
When you’re working towards a settlement and your recovery, it is natural to want to know right away how much compensation you will receive for your injuries. Every case is different, and the outcome of every case is based on the unique facts of that case. However, working with an experienced car accident lawyer can help to ensure that you receive ample compensation for injuries, medical expenses for the present and for the future as related to the accident, vehicle and other personal property damages, lost work time and wages, loss of the ability to work, personal pain and suffering, long term care, and more. By working with a skilled personal injury attorney you ensure that every aspect of your accident, your injuries, and your recovery are taken into account and that you receive the compensation you truly deserve. Our attorneys work hard to ensure that you don’t get "stuck with" whatever the insurance company sets as a limit, but instead get what is needed to help you through your full recovery.
Arizona Texting Laws
Using a cell phone while driving is illegal in Arizona. You cannot hold a cell phone or smart device in your hand or support it with your body, such as keeping it perched on your shoulder. None of the following activities are permitted using a handheld device:
Reading or sending texts
Making or answering phone calls
Scrolling media
Watching videos
GPS navigation
Drivers are allowed to use a hands-free device for talking on the phone and for GPS navigation. You are also permitted to use your cell phone to call 911 in an emergency or to report a crime.
Fines for the first violation for using a handheld device while driving range from $75 to $149. Violators will be fined between $150 to $250 for each subsequent offense.
Proving Liability in Phoenix Cell Phone Accident Cases
With the majority of people now using cell phones and handheld devices every day comes the risk that they'll distract drivers on the road. Even a moment looking down to read a text or check a map can cause dangerous and even deadly injuries to other drivers, bikers or pedestrians.
In order to get financial compensation for an injury because of a cell phone accident, you'll need to prove that the other driver's negligence led directly to the accident. An experienced personal injury lawyer can help you by investigating the facts of your case and gathering supporting evidence.
Police and medical reports will need to be collected. Witnesses will need to be contacted. Experts will have to be called in to testify in court. Cell phone records will have to be presented. You're not a legal expert. Having a cell phone car accident lawyer at The Husband & Wife Law Team on your side will get these things done.
